NearMow Terms of Service

These Terms of Service ("Terms") govern your access to and use of NearMow (the "Platform," "we," "us," or "our"), operated by NearMow LLC, a Tennessee limited liability company located at 116 Agnes Rd Ste 200, Knoxville, TN 37919. By creating an account, requesting a service, or accepting a job through NearMow, you agree to these Terms. If you do not agree, do not use the Platform.

1. What NearMow Is

NearMow is a marketplace that connects homeowners ("Homeowners") seeking lawn care services with independent local providers ("Specialists") in the Greater Nashville, TN area. NearMow does not itself provide lawn mowing or lawn care services. Specialists are independent contractors, not employees, agents, or representatives of NearMow. NearMow is not a party to the service agreement formed between a Homeowner and a Specialist when a job is accepted, and NearMow has no control over, and assumes no responsibility for, the manner, quality, or outcome of any service a Specialist performs.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use NearMow. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information, including your service location, and to keep it up to date.

3. For Homeowners

  • You may request lawn mowing and related services through the Platform.
  • You authorize NearMow to charge your saved payment method for the price shown at the time of your request, including any applicable platform fee.
  • You are responsible for providing safe, reasonably accessible property for the Specialist to perform the requested work, and for disclosing any hazards (pets, uneven terrain, obstacles, sprinkler heads, etc.) relevant to the job.
  • NearMow does not guarantee the availability, timeliness, or quality of any Specialist's work. Disputes about work quality should first be raised directly with the Specialist through the Platform's messaging feature; see our Refund Policy for how NearMow may assist.

4. For Specialists

  • You must complete any required onboarding, including identity verification and payment setup through our payment processor, Stripe, before accepting jobs or receiving payouts.
  • You are an independent contractor, not an employee, agent, or representative of NearMow. You are solely responsible for your own equipment, insurance, taxes, licensing, and compliance with all applicable laws in the course of providing services.
  • You are solely and fully responsible for the quality, safety, and legality of the services you perform, and for any property damage, personal injury, or other harm arising from your performance of a job.
  • You agree to complete accepted jobs in a timely, professional manner and to accurately represent the services you offer, including any custom or "Other" services you list.
  • NearMow may charge a platform fee on each completed job, deducted before payout, as disclosed in the Platform at the time of the job.
  • NearMow may offer an optional paid subscription ("NearMow Pro") providing additional features or reduced fees, billed on a recurring monthly basis until canceled. Subscription terms are as displayed at signup.

5. Indemnification (Specialists)

By accepting a job through the Platform, you (the Specialist) agree to indemnify, defend, and hold harmless NearMow LLC, its officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) property damage, personal injury, or other harm caused by your performance of services, or your equipment, in the course of a job; (b) your breach of these Terms; (c) your violation of any applicable law, license, or third-party right in the course of providing services; or (d) any dispute between you and a Homeowner arising from a job. This indemnification obligation survives termination of your account and applies regardless of whether NearMow is named as a party to a claim brought by a Homeowner or any third party.

6. Payments

All payments are processed through Stripe. By using NearMow's payment features, you also agree to Stripe's Connected Account Agreement. NearMow does not store your full payment card details. Homeowners are charged at the time a job is completed or as otherwise disclosed in the Platform. Specialists are paid out via Stripe Connect according to Stripe's standard payout timing, less any applicable platform fee.

7. Prohibited Conduct

You agree not to: use the Platform for any unlawful purpose; attempt to circumvent NearMow's payment system to transact off-platform in a way that avoids platform fees; harass, threaten, or discriminate against other users; misrepresent your identity, location, or qualifications; or interfere with the Platform's normal operation.

8. Disclaimers

NearMow provides the Platform "as is" and "as available." We do not warrant that the Platform will be uninterrupted, error-free, or secure. NearMow makes no representations or warranties about the quality, safety, legality, or outcome of any service provided by a Specialist, or the reliability, conduct, or property condition of any Homeowner. NearMow is a venue that connects Homeowners and Specialists and is not responsible for verifying the skill, licensing, insurance status, or conduct of any Specialist beyond the onboarding steps described in these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, NearMow LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for any damages, injury, or loss arising from services performed by a Specialist, property damage, personal injury, equipment used by a Specialist, or disputes between Homeowners and Specialists — responsibility for which rests solely with the Specialist who performed the job, as set out in Section 5. NearMow's total liability arising out of your use of the Platform, for any claim not covered by Section 5, will not exceed the greater of $100 or the amount you paid NearMow in platform fees in the three months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or repeated complaints from other users. You may stop using the Platform and close your account at any time by contacting us.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by an updated "Last updated" date.

12. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
